General Terms and Conditions
These Terms and Conditions apply to all translation services provided by SimplyTranslate (ABN 67 580 165 164) to the client.
By placing an order, the Client agrees to be bound by these terms.
1. Scope of Services & Certification
1.1. The Translator will provide digital, certified translations of documents as agreed in writing.
1.2. Certified translations are performed by a NAATI-certified translator, including the translator’s name, NAATI number, date, and a statement of accuracy.
1.3. The final product is delivered digitally as PDF files unless otherwise agreed. The client is responsible for printing, if necessary.
2. Client Obligations
2.1. The Client must provide clear, legible, and complete documents for translation.
2.2. The Client must specify the purpose of the translation (e.g., DHA, legal) to ensure appropriate certification standards.
2.3. The Client warrants they have the authority to translate the documents provided.
3. Fees and Payment
3.1. Orders must be paid in full upon receipt of "watermarked" (protected) documents for the release of final documents.
3.2. Quotes are valid for 30 days and are based on the initial documentation provided. Additional text found later may attract extra fees.
3.3. Payments are generally non-refundable once work has started.
4. Delivery and Revisions
4.1. The Translator will aim to meet agreed deadlines. However, these are estimates, and the Translator is not liable for delays outside their control.
4.2. Review Period: The client has 24 hours from receipt of the digital translation to request corrections. If no feedback is received within this time, the project is deemed accepted.
4.3. Revisions are restricted to inaccuracies in translation and do not cover stylistic changes or errors present in the original source document.
5. Liability and Disclaimer
5.1. While the Translator strives for 100% accuracy, they are not liable for direct, indirect, or consequential loss or damage resulting from the use of the translations and its potentialinaccuracies as a result of misinterpretation.
5.2. The Translator is not responsible for verifying the authenticity or legal status of the source materials.
5.3. Liability is strictly limited to the amount charged for the specific translation service.
6. Confidentiality and Intellectual Property
6.1. The Translator will keep all documents confidential and securely stored.
6.2. The Intellectual Property of the translation remains with the Translator until full payment is received.
7. Termination
7.1. If the Client cancels the project, they are liable for payment of all work completed up to the cancellation date. Upon request, and once partial payment is received, SimplyTranslate will release the unfinished and uncertified work to the client up to the point of the cancellation request.
8. Governing Law
8.1. These terms are governed by the laws of QLD, Australia.
